Observations & Responses
Observations are descriptive overviews of policies that are shaping open scholarship in Canada and beyond. They aim to provide an overview of both the policies’ impact and the responses of the academic and non-academic communities. We cover a range of topics, including both recent and touchstone policies. Responses are written by INKE Partnership Members and are critical engagements with policies from the unique perspectives of individual Partnership Members, who represent researchers, librarians and stakeholders at the forefront of digital scholarship in Canada and beyond.
The Extension of Canada’s General Term of Copyright under CUSMA (USMCA)
Under the Canada–United States–Mexico Agreement (CUSMA) (also called the US–Mexico–Canada Agreement or USMCA in the US and Tratado entre México, Estado Unidos y Canadá or T-MEC in Mexico), a trade agreement that includes a chapter on intellectual property, Canada has committed to extending its general term of copyright by 20 years, from the life of the author plus 50 years to the life of the author plus 70 years.
La Semaine internationale du libre accès 2021, 25–31 octobre
La 14e Semaine internationale du libre accès se déroule du 25 au 31 octobre 2021 et le thème de cette année est « L’importance de notre façon d’ouvrir la connaissance : construisons l’équité structurelle ». Ce thème a été choisi pour s’aligner sur la recommandation de l’UNESCO sur la science ouverte (voir « La Recommandation de l’UNESCO sur la science ouverte »), qui met en avant l’importance de l’équité dans l’avancement d’érudition qui est ouvert par défaut (Fandel 2021).
International Open Access Week 2021, October 25–31
The 14th annual International Open Access Week runs from October 25–31, 2021, and this year’s theme is “It Matters How We Open Knowledge: Building Structural Equity.” This theme was chosen to align with the UNESCO Recommendation on Open Science (see “UNESCO’s Recommendation on Open Science”), which “powerfully articulates and centers the importance of equity in pursuing a future for scholarship that is open by default” (Fandel 2021).

Open Science and the UNESCO initiative
Open Science and the UNESCO Initiative. Scientific inquiry has long been a self-organized enterprise. Governments, funders and universities may all, from time to time, have prescribed priorities for scientific inquiry, but scientists themselves have largely determined how inquiries should be conducted. In the process they have created and stewarded their own organizations: learned societies, academies, and centres within the generally flexible framework of their universities.
Open Access Agreements
In March 2021, The University of California (UC) announced a “breakthrough” open access (OA) agreement with Elsevier, the world’s largest scientific publisher (2021). Under the agreement, all articles with a lead author based at UC will be OA upon publication, and researchers at UC will have access to read articles in Elsevier journals.

Update: Research Data Management in Canada
In March 2021, the Government of Canada announced the release of the Tri-Agency Research Data Management Policy (RDM Policy). A draft of this policy for consultation was released in May 2018 (see “Tri-Agency Research Data Management Policy”).

As the international open access (OA) movement gains momentum, the question of how to make the shift to OA for monographs is becoming more pressing and, in recent years, efforts to determine a sustainable model for publishing OA monographs have increased.
